La "Teoría Jurídica de la Premeditación" fue un ensayo, publicado en la revista jurídica de Santander, dirigida por el autor del mismo, Manuel Enrique Puyana, en seis entregas.The "Teoría Jurídica de la Premeditación" [Legal theory of premeditation], was an essay, writed by Manuel Enrique Puyana, Colombian lawyer, and published in the Revista Jurídica de Santander [Santander Legal Journal] in six numbers, from 1919 till 1926.
In this essay, the autor discusses the concept of "premeditation" als homicide rate, which is considered more serious, just after the voluntary and accidental homicide. The author takes as a reference the Italian school of criminology, and based on this theory, confronts the Criminal Code of 1890, which governed until 1936.
This essay shows, on the one hand, the influence of the Italian criminal theory in the law thought, and the other is a document that served as a reference for lawyers, judges and prosecutors within the different homicide cases that were conducted in the Department of Santander , Colombia, mainly during the second decade of the twentieth century.
